Terms and conditions for safety, liability and indemnities

  • No later than one week before the performance date, the performer/performing company will send the theater a certificate issued by an occupational health and safety service, showing that the production meets the statutory safety requirements (RIE Production).
  • If the theater does not have this certificate, the theater may cancel the performance and the performer will compensate the theater for the damage it has suffered (costs incurred and income foregone). The theater will send an invoice for this damage, which will be paid by the performer within one month of receipt.
  • The parties agree to guarantee the safety of everyone in the theater to the greatest extent possible. In this context, theater also includes loading and unloading areas as well as parking spaces outside the building in which the theater is located, to the extent that these are used for activities in preparation for the performance.
  • The parties are obliged to work according to procedures that meet the statutory requirements in accordance with the Working Conditions Act (Arbo-wet) and the Working and Resting Times Act (Arbeids- en Rusttijdenwet).
  • The performer/performing company will send the theater fully completed technical information well in advance of, and no later than four weeks prior to, the performance. On the basis of this information, the theater and the performer /performing company will discuss any special precautions to be taken in connection with safety.
  • The performer/performing company will inform the theater, of his/its own accord and in good time, of any special dangers in terms of the materials to be used by the performer and/or the working method to be followed.
  • The theater has the right to inspect the materials used by the performer and his working methods at any time.
  • The performer's/performing company’s activities, sets, and materials and equipment to be used must comply with the applicable statutory (safety) requirements and fire regulations at all times. Decisions regarding these matters are at the discretion of the stage manager or his representative.
  • If the safety of people and/or goods is or could be endangered by the materials used and/or the working method used by the performer, as determined exclusively by the theater, then the theater has the right to cancel the performance. In that case, all damage resulting from the cancellation will be the responsibilty of the performer.
  • The performer indemnifies the theater against all claims by third parties as a result of a cancellation of a performance on the basis of the conditions described above.
  • The equipment present on the lessor's premises may only be operated by the lessor's own staff.
  • Access to service areas is prohibited without supervision by one of the lessor's employees.
  • On the day that the production set is built, a final inspection will be carried out according to a checklist drawn up by the stage manager.
